LANDLORDS FLEE BUY TO LET The number of private rented homes has dropped by 46,000 as landlords flee the buy to let market, according to official figures. Private rented homes still comprise a significant sector of the market, although private rentals decreased to 4.8 million. The ministry suggests the fall in the number of properties could be the result of the 3% surcharge private landlords must pay on buying a home to rent. The research also found that although landlords ar...e selling buy to let homes, few property investors are in the market to buy. Letting agent trade group ARLA Kitemark also confirmed landlords are leaving the market. Other research also suggests that a reason that landlords are leaving the market could be due to problem tenants with unpaid rent or the punitive legal system. The amount of money landlords are owed in unpaid rent has been rising, as higher inflation places pressure on renters’ incomes. A third of landlords experienced rental arrears, with the average amount owed totalling £1,650, over the year to autumn 2018, according to the Residential Landlords Association, a trade body. This is a 4.2pc increase on a year earlier. From May 25th 2018, the General Data Protection Regulation (GDPR) will form the new standard by which landlords and agents deal with personal information about their tenants and clients. It replaces the Data Protection Act and introduces a number of significant changes to the way you should be processing personal information.
Under the GDPR, you will need to audit the information you collect and hold, decide under what lawful basis the information is being processed, document... the audit and have privacy notices available for persons to view which will usually be provided at the time of collecting any personal information.
Processing personal information:-
Article 5 of the GDPR requires that personal data shall be:
• processed lawfully, fairly and in a transparent manner • collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes • adequate, relevant and limited to what is necessary • accurate and kept up to date • kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed • processed in a manner that ensures appropriate security of the personal data.
Consent
The GDPR sets a high standard for consent. But you often won’t need consent. If consent is difficult you can look for a different lawful basis. • Consent will be needed for using any personal information for the purposes of sales or marketing for example. • Consent means offering individuals real choice and control. • Avoid making consent to processing a precondition of a service. • Consent requires a positive opt-in. Don’t use pre-ticked boxes or any other method of default consent. • Explicit consent requires a very clear and specific statement of consent. • Be specific and ‘granular’ so that you get separate consent for separate things. Vague or blanket consent is not enough. • Name any third party controllers who will rely on the consent. • Keep your consent requests separate from other terms and conditions. • Keep evidence of consent – who, when, how, and what you told people.

Universal Credit Rollout
More than a third of private landlords with tenants receiving Universal Credit have said that they are now in rent arrears, which is an increase by over 10% since last year.
According to a recent survey by the Residential Landlords Association (RLA) of almost 3,000 landlords, of those with Universal Credit claimants as tenants, 38% reported experiencing tenants going into rent arrears, up from 27% in February 2016.
... The government plans to increase the pace at which Universal Credit is rolled out across the country from next month.
Many landlords and tenants alike would welcome the principle of simplifying the benefit system, but as it stands currently the design of Universal Credit is having a major impact on tenants leading to severe rent arrears.
This is not financially responsible and does nothing to encourage landlords to house people needing to claim benefit.
Thousands of benefit claimants are facing debt, rent arrears and eviction as a result of policy design flaws, an overhaul of the system is needed to ensure the stability for tenants and landlords.
Ministers are being urged to slow down the national rollout and to increase support for vulnerable claimants who are struggling to cope with the demands of monthly payments and an increasingly online-only system.
A spokesperson for the DWP argued that the best way to help people pay their rent was to get them into work and that UC was doing that faster, and helping them remain in a job.
However, the DWP acknowledged some issues with the full rollout of universal credit. “However, by working with local authorities and landlords, we’re providing extra support to those claimants who need it and are sorting out any issues as quickly as possible.”
As the complete roll out is now drawing closer, it will inevitably show the full extent of the stability of Universal Credit soon enough.

An insurance company has recently carried out research across the market and claims that on average landlords can save up to £2,000 per year if they contract letting agents, when compared to those who prefer to deal directly with tenants.
They say that landlords working with a good and reliable letting agent on average save £1,910 per year. The main savings are made by having less void periods and a higher rental income secured by their agent. Landlords who deal with their te...nants directly save an average of £159 in monthly costs.
The significant advantages of using an agent are because of their local knowledge and strength in achieving higher rents for their 'clients'.
The survey asked landlords who took part the main reasons for using a letting agent and 50% said the biggest benefit was their local expertise, 41% said being able to enjoy the feeling that they did not have to worry about the property as it was in a 'safe hands'.
Managing director of property specialist, Allison Thompson, said: ‘There is a misconception among some landlords that a successful letting agent will not add value to your investment. This is not true, as the figures show landlords who work with letting agents enjoy a significantly higher return. The marketing power of an established agent gives your property the best chance of being rented by a quality tenant as soon as it goes on the market."
She continued: "Some DIY landlords understandably struggle to bring a home to the attention of prospective tenants and suffer lengthy and costly voids as a result. However, a good agent will not stop at finding a great tenant for your property. They will also offer support with legal matters, repairs and maintenance, avoiding rent arrears
If someone is in arrears it means they have fallen behind with rent payments if this happens, the landlord must act promptly and comply with a strict legal process and minimising risks, all of which can help to reduce overall costs and provide you with ultimate peace of mind."

Housing benefit is to be axed for 18-21 year-olds within weeks after ministers decided to go ahead with controversial plans to force young unemployed people to live with their parents or pay their own rent. The new Universal Credit regulations, which are secondary not primary legislation and open to less scrutiny by MPs, state that jobless under-22s will no longer qualify for help with their rental costs. housing charities had hoped that Work and Pensions Secretary Damian Gre...en would scrap the plans amid fears they could force thousands of youngsters onto the streets.
But on Friday, the DWP laid the regulations before Parliament and made clear that while some exemptions would be made, the change would go ahead. The policy will apply only to claims for Universal Credit made after April 1.
