Rent-to-rent We were recently made aware of the case of a landlord who let out his three-bedroom property through a well-known letting agent. The agent suggested he let his property to a limited company ŌĆō in whatŌĆÖs known as ŌĆśRent-to-rentŌĆÖ,alt...hough it wasnŌĆÖt made clear what the companyŌĆÖs intentions were.
The letting agent then prepared a three-year AST with a no sub-letting clause between the landlord and the limited company. As you are aware an AST cannot be signed by a company, and instead it should be a lease, management agreement or company let (depending on the circumstances). This issue is covered in a useful blog on the London Property Licensing website.
The Rent-to-rent company then sublet individual bedrooms thereby creating a licensable but unlicensed HMO. The council issued a warning to impose a financial penalty to the landlord who had no idea it was being sublet as an HMO and he is appealing against it. He is now going back to his agent in relation to the bad advice given. He had no idea the property was being sub-let as an HMO.
The case highlights some of the issues that can arise with Rent-to-rent and reminds that an AST canŌĆÖt be issued to a limited company.
