We offer tribunal representations and form filling services for ESA / DLA / PIP applications. Those who suffer with illnesses perceived as invisible are our specialties, ie Fiibro, Hypermobility, Mental Heath and ME.

Good afternoon Mr Lea,
Re your enquiry regarding the reason why PIP award reviews ( similar to DLA renewal claims) are instigated in advance of the end of the PIP entitlement period
... It is essential that there is enough time to process a claim for Personal Independence Payment for a further period so that, if entitlement is to continue, there is no inconvenient break in payment. An award review involves a thorough appraisal of the evidence and this can take some time to complete. ‘Limited period’ awards are not automatically extended, and to enable the necessary procedures to be completed we invite customers to complete a claim pack up to a year before the end of the award. Therefore if further information is needed from health care professionals or other sources, there is sufficient time for DWP to obtain this before making a decision.
One of the recommendations made, when PIP benefit was created, is that every claimant that receives PIP is subject to a periodic review. The old Disability Living Allowance (DLA) system that is being gradually replaced by PIP was outdated, with the majority of customers getting DLA for an definite period without systematic checks on their condition or entitlement. PIP includes a face-to-face assessment for most claimants and regular reviews to ensure support goes to those who need it most.
The review date for PIP awards is based on advice given by the Assessment Provider’s health professional about the recommended length of award. When implementing the PIP decision, DWP case managers increase the period of the award recommended by a period of 12 months to allow DWP sufficient time to process a review up to 12 months prior to the end of the award. This is to ensure that there are no periods between possible entitlements where a claimant will not be receiving the level of PIP that they are entitled to. A similar principle applies to awards of PIP made by an Appeal Tribunal. The setting of a review date is a function of the Secretary of State. DWP ( acting on behalf of the Secretary of State) provides instruction to PIP case managers to include a review date in certain Appeal Tribunal award periods depending on the length of the award and the individual circumstances of the case, for example, where the length of award is for over 2 years or where the care or mobility needs are likely to change.

Hello.
I am aware that when people are awared for a period. That 12 months before the end of the award they are requested to attend another assessment, before the original award date expires. How can this be? Is this factually correct or can you provide a link to the Law stating this is allowed please? As currently, people are having their awar...ds 9 months prematurely, before the first lawful decision was made. My understanding at Tribunal is, that unless the DWP have made considerable attempts via law to change original award prematurely, then no assessment before expiry date is lawful.
Unless you feel or believe in Divine intervention or Miracles of science is correctly being suggested. I would ask these question or get some one to ask.

People are questioning why are their disabilities not being accepted.
That is not the case, your functionality is being brought into question? Is it as bad as you have stated on your application form !
THEREFORE BEST WAY TO CHALLENGE THIS IS -:
... Best way is to show constant contradiction from the HP's PA4. Remember this is not about DISABILITY OR CONDITIONS, it is whether you can function better than you state in your application. Keep sharing diagnosis and proof of conditions are not being questioned by the DWP and all you are doing is harming yourselves by expanding energy that has no relevance to a Tribunal. Can you do it, reliably, repeatedly, safely, without pain/fatigUe or anxiety ever being present, with trips, falls, seizures, brainfog, burns scalds etc being a daily threat to your mental or physical wellbeing. This is THE CRUX OF DWP ASSESSMENTS.

This is a very complicated area, regarding beaucracy and hitting the pension age of 65.
Basically the rules are. If you apply for PIP before you reach pension age of 65 for benefits, if mobility is an issue it will be awarded.
If you are over 65, you cannot apply for PIP but apply for Attendance Allowance, this does not come with a mobility Award.
... Now since PIP implementation, we have noticed a huge increase of pensioners over 65 after PIP assessments loosing their mobility. Now wether this is deliberate or a policy not considered, but we have seen an increase of the claimants at pension age losing their cars ( we have seen a very high percentage at tribunal OF THESE DECISIONS being over turned).

This service should go national, too many people suffering and even dying with such a Draconian Government in power. The Tories have no empathy or interest for the disabled, to them we are a burden on tax cuts for the few. And as far as managing the purse strings of the economy, we are worse off, we owe more and all but the rich elite are paying the price. The question is; how many M.P.'s form all parties have private medical insurance, how out of touch does this make voting to discriminate against the weak, ill and disabled; make them?

This is an amazing group that has taking what was gonna be a pretty shitty xmas with no money into something good . In 2 short weeks Tony has spoken to me with empathy and compassion, has reassured me with his knowledge and simple procedures to follow . The assessor has lied completely to reach a target regardless of my condition ( fibromyalgia, hypersensitivity, anxiety ) without contacting anyone about my condition. Without this team I probably would of had a terrible xmas but now at least me and my 3 year old can afford some food and heat . Thank you x

The most amazing service there is ...

pip assessment awarded my son with 0 points and money stopped , appeal gave me the same . I then found out about the wonderful Tony and his team , who saved the day . Saved me from the stress and worry of a tribunal . We have just been awarded enhanced mobility and enhanced daily living . Autism is invisible to many but affects a whole family and I can never thank you enough for your professional help and care .

Thanks to tony my pip is back i am so thankfull .i can now put the heatting on and eat better it was a very hard nealy 9 mouths without it but tony fight for me to get it back . if u need help he is your man

Thank you so much for Tony, for your's and your teams help for the second time. Two years ago I called you for help when my epileptic son, was declared fit for work at his ESA Assessment, while he was suffering from uncontrolled grand mal seizures & recurrent dislocations of his shoulder. You got that decision overturned within a week!

So when my "migration" from DLA to PIP came up in March, you were the first person I called, you filled the forms, with help from my GP you got a home assessment arranged for me, attended and recorded the assessment, the end result I am happy to say, was pip enhanced rate for care and mobility. I seriously cannot thank you enough for your help. I would recommend that anyone who needs someone fighting their corner for them, give Tony a ring, because fight for you he will!

I will be in touch again when my Autistic son comes up for migration from DLA to PIP!

Just to let you know I will be making a donation shortly, you do amazing work for so many.

Only contacted Tony a few days before he broke up for the Christmas break, had an appeal hearing on 2nd January with no support or help, Tony asked for an adjournment to give him time to look at my paperwork, have been granted the adjournment, now waiting for another date. Thank you so much Tony for your help so far. Has taken so much off my mind.

Knocked for six by the DWP and without the help of this group I would of been totally lost. They have been a true lifeline and invaluable help from the first contact in knowing the rules and regulations you would think the DWP should know themselves! Thankful for a a fast change of mind by the DWP once Benefit Resolutions were involved.

It sounds like we need Tony on our team. My daughter had her PIP abruptly cut off last March and was left without means until now - December. Her appeal is towards the end of January. Maintaining her has emptied my bank account. We hope for a favourable ruling in January but if not. . . I shall be bringing Tony on board.

Initial contact with tony today has helped us feel like we arent alone after what i can only describe as a nightmare 6 months in our new home,universal credit is proving to be every bit as brutal as we were hearing through social media & other friends experiences!

I would just like to say thank you so much to Tony from benefit resolutions who with my husband Michael ,we met yesterday,Tony was so helpful and said he would do all he could to help us, well true to his word he did, 24 hours later my husband's tribunal has been stopped and an award is pending, we have had a very stressful few months because of atos and their assessment system, I don't know what we would have done if it wasn't for Tony and the fact he brought to the dwp's attention just how serious my husband's health is,as they didn't listen to us, so Tony a very big thank you from us.

Had my PIP tribunal today. Admittedly, I represented myself, HOWEVER, I would have really struggled if it wasn't for the general help advice and supporting info that you share upon your page freely, to all in need. THANK YOU, from the bottom of my heart. Oh yeah, nearly forgot, I won... From zero points at initial assessment, tribunal awarded me 8 points for daily living component and 8 points for mobility. Only sad part is having had to fight hard for something that I was entitled to all along. Don't give up the fight!!! Xxx

Fantastic service, made the nightmare of a PIP application so much easier and successful. I didn't expect to have an increase to my award but Tony said I should and amazingly I did. Great value for money and I'd say a real investment considering the difficulty I've always experienced previously.
