The new H-1B online registration procedure will go forward in March 2020. The registration procedure will work effectively as a lottery and save petitioners from writing petitions that will not be adjudicated due to not being chosen. https://www.chavinimmigration.com/n…/h- 1b-lottery-march-2020

I've started reading the new public charge rule and blogging as I go to give a summary overview. The version of the new rule that I am reading is 837 pages long. The table of contents is six pages! https://www.chavinimmigration.com/…/pub lic-charge-rule-augu…

"People don’t have a right to asylum, sight unseen, but under international human rights law and our own immigration laws, they have the right to seek it. They have the right to knock on the door and say, “Help, a wolf is chasing me, let me in!” When that happens, we’re supposed to give them food and drink, and to let them sit by the fire and tell their story — and if it’s true that they’re in danger, we are supposed to give them shelter. It’s wrong to block their way and force them to wait on the front step, while we decide if we’re ready to listen." https://www.washingtonpost.com/…/1c9f98 f0-a962-11e9-9214-24…

Know your rights Info. You only need to open a door in the US if someone has a judicial warrant. This is a warrant signed by a judge, not an ICE official. Here are examples of an ICE Arrest Warrant (do not open for this) and a judicial warrant signed by a judge.

Interviewed today about the effect of admitting to controlled substance usage on a foreign national's ability to travel to the United States. From Owen Bowcott, the Guardian's Legal Affairs corespondent. https://www.theguardian.com/…/michael-g ove-deny-entry-us-co…

Video explanation of Matter of M-S-, a recent decision taken over by the attorney general in the immigration courts. Usually immigration judges write these decisions. This decision would eliminate bond hearings for asylum seekers who state that they have a credible fear of return to their country. Without the credible fear, they would be sent back to their country in an "expedited removal." Previous to M-S-, they could have a bond hearing and be bonded out of detention. The decision will take effect in 90 days if nothing is done in the courts. The 90 days will give the Department of Homeland Security time to make more beds available for asylum seekers.

US Entrepreneurship/ Investment based Visa News! Per an announcement on the US Embassy website in Israel: Israel and the US have signed a reciprocal treaty such that Israeli is now an approvable "nationality" for a US E visa business. The treaty will have effect from May 1, 2019. US entities with more than 50% Israeli ownership will be qualified for E visa investment.

Court orders a temporary stop to the "Remain in Mexico" policy, where asylum seekers for the US who enter legally are nonetheless sent back to Mexico to wait for their court dates. The injunction validates the legal challenge from the plaintiff non-profit agencies defending asylum seekers. US lawyers cannot help prepare clients for immigration court hearings when their clients are in Mexico. https://assets.documentcloud.org/…/4-8- 19-Innovation-Law-La…

This evening, I organized with colleagues a successful third regular meet up of the American Immigration Lawyers Association EMEA based chapter. We met physically in Boston, London and Washington, DC for a presentation beamed from Boston by phone lines - on the travel ban. We discussed requests for waiver of the ban for certain individuals and federal litigation related to it. Great presentation and Q and A afterwards. Here we organizers are relaxing together afterwards in London.
