What are my entitlements to my husband’s pension, we have been married for almost 17 years?
It is now certainly the case that your husband’s pension fund is part of the matrimonial pot.
The pension can be dealt with in a number of different ways. There are three main options to consider:
... 1. Offsetting. This is where the value of the pension is balanced against the value of other assets – often the matrimonial home. This is a simple method of dealing with a pension but in many cases is far from ideal as one pound of pension asset is rarely equal to one pound of property asset and it may leave you short of income in your retirement. 2. Attachment. This is where a percentage of your husband’s pension is set aside for you on his retirement. This solution however has a number of pitfalls, particularly if your husband dies. It also maintains a link between you that you may not want. 3. Pension sharing. This is now by far the most popular method of dealing with pensions. It allows for a percentage of your husband’s pension to be hived off to form your own pension fund, entirely separate from that of your husband’s.
The whole area of pensions is complicated and you should take advice as to the best way to proceed.
We often hear from client’s that they would be happy to settle for 50% of the pension fund.
However, for women that is unlikely (for a variety of actuarial reasons) to produce equality in payments receivable. A proper actuarial investigation should be completed which will take into account the way in which annuities are calculated to ensure that you receive a pension fund that will be sufficient to meet your retirement needs.

What orders can be made?
On a divorce (or Judicial Separation) each party has the right to make various claims against the other. These include: • orders for cash lump sum payments. These could be for any number of reasons, but commonly would be utilised to buy a new home or car. • transfer of property or other assets – where ownership of an asset is transferred to one of the parties. This is often the former marital home but can also incorporate investments and savings plans.... • maintenance – where one party pays to the other an amount of money each month • pension sharing
Even where there are little or no assets, it is important to have a court order. A court order provides the certainty needed that neither of you can make claims against the other in the future. Without such an order, it is possible for your ex spouse to make a claim against you, even years after the divorce. This might happen if your business expands, you receive an inheritance, or if your finances improved for some other reason.
