Garrick Law Director, Narita Bahra appeared on BBC News yesterday after she secured an acquittal in a multimillion pound red-diesel fraud. Narita represented one of 11 defendants in Trial. The prosecution offered no evidence. Judge Trevor Jones said that the fraud case showed "lamentable negligence". This case is illustrative of disclosure failings extending beyond cases involving sexual allegations.

Collapsed trial woman says she gave birth “alone” in prison due to the repeated failure to properly disclose by the CPS.
Garrick Law Director, Narita Bahra appeared on BBC News at 6pm this evening to discuss her recent case at London’s Wood Green Crown Court. Ms Bosoanca, 25 years old, was arrested in December 2016. She was accused of conspiring to traffic a young woman to the UK from Romania for the purpose of prostitution. The complainant had claimed that she had been traff...icked and forced into prostitution by Ms Bosoanca (and two other defendants). The complainant stated that she had become pregnant after being raped in the UK. It later emerged the woman was already pregnant when she entered the Country in 2016, when she was examined three days after the arrest of Ms Bosoanca.
His Honour Judge Perrins said the defence team had requested medical evidence as long ago as August 2017 and had repeatedly been told that no such medical evidence existed. This repeated failure to properly disclose the police doctor’s reportwas, according to the Judge “one of the more serious failings identified in this case and requires further explanation.”
Facebook messages which showed the complainant discussing the pregnancy and identity of the father was known to the police from January 2017 but not disclosed until December 2017. It took four days’ solid work to find evidence that undermined the prosecution case in the disclosed material. Further some 65,000 lines of text messages were disclosed to the defence on day two of the trial. It was only after the complainant in the case had been cross-examined, on the 17th day of trial, that it was stopped.
Ms Bosoanca states of the CPS and the Police “I think they were incompetent all of them”. A senior prosecutor today, apologised to the Court and said the CPS’s handling of the case had “fallen below standard”. The Judge has said that he would be referring the case to the Director of Public Prosecution.

Garrick Law Director, Narita Bahra exposes more disclosure failings by CPS!
Narita represented one of three defendants charged with trafficking the complainant to the UK to work in prostitution. After meticulous and extensive cross examination by Narita, the CPS dropped the case on the 17th day of trial.
There were disclosure problems from the outset including the disclosure of over 65,000 text messages and significant evidence to this case proving the complainant was alread...y pregnant before she came to the UK after the trial had commenced.
His Honor Judge Perrins stated that it appeared as though the Court had been significantly misled as to the prosecution's state of readiness as well as the strength of the evidence at previous bail hearings and applications to extend the custody time limits.
The Judge noted the fact that Narita’s client had twice had her custody time limits extended on the basis of such misleading information and as a result had to give birth in custody made the CPS failings all the more shocking.

Sky News interviewed Garrick Law Director, Narita Bahra this afternoon. She provided a legal defence perspective to the Justice Secretary’s decision to Judicially Review the Parole Board’s decision to approve the release of John Worboys. Worboys is a sixty-year-old black cab driver who was jailed indefinitely in 2009, with a minimum term of eights years, for drugging and sexually assaulting women passengers.
Narita addressed the inadequacies of Indefinite prison sentences (under which Worboys was sentenced), the Public protection sentencing regime and considered how the sentencing laws for sexual offences have developed in 2017, since it’s abolishment.
