Kernon Kelleher Solicitors has been created as the company’s “High Street” brand. Neil Kernon founded On Demand Lawyers, moving to Dorset in 2011. Saul Kelleher has been a director in a large regional practice and, like Neil, lives locally. Why do you need LPAs?
A lasting power of attorney (LPA) is a legal document that lets you appoint one or more people to help you make decisions or to make decisions on your behalf, particularly at times when you are unable to do so for yourself. If you don’t have registered LPAs in place then, to consider the position further, ask yourself whether you would not insure your house against the risk of fire.
... It is a common response from clients that they do not need LPAs because there is nothing wrong with them. When it comes to LPAs it is the very nature of the documents that dictates that they can only be created whilst there is “nothing wrong”. When LPAs are created the hope is that they will not be used, but they are there if the worst comes to the worst.
Insurance against your house burning down is there not in the hope that your house burns down, but for the peace of mind that you are covered if it does burn down. Having LPAs is like having insurance in place on your own well-being so that, if the worst does happen and they are needed, you have them, they are ready to use and the people using them will have been chosen by you. There are two types of LPAs: Property and affairs LPA - These are designed for you to appoint attorneys to make a range of decisions including the buying and selling of your house and other assets, dealing with your tax affairs, operating bank and building society accounts and claiming benefits on your behalf. These can be used at your direction while mentally capable and also by the Attorneys if you lack capacity to make these decisions. Personal welfare LPA - Attorneys appointed under this document can make decisions relating to your living accommodation and care, consenting to or refusing medical treatment on your behalf, and on day-to-day matters such as diet and dress. This can only be used, however, if you have lost the capacity to make decisions for yourself.
