An interesting question! Is there more than one way to inherit?
We have enjoyed helping many clients but we wanted to share a clients particular situation with you to raise your awareness of what can be done.
... Mr & Mrs A were introduced to our Senior Partner, Chris. They had a net worth of around ┬Ż1.7m. Mr A, had just inherited ┬Ż159,000 from his step mum which he wasn't expecting. Concentrating on the inheritance, Chris explained the threats of divorce, care fee's and immediate IHT liability (Tax). Mr & Mrs A were unaware of the threats like so many people. We have now completed a piece of work called 'Deed of Variation'. This retrospectively changes Mr A's step mothers Will and places the ┬Ż159,000 in Trust. This means that the money is immediately outside of Mr & Mrs A's estate saving their beneficiaries ┬Ż63,600 of IHT alone plus safeguarding the money against ALL the everyday threats.

THE BAD NEWS: Some fairly monumental changes in the Probate charges proposed to come into effect from April 2019!! Probate costs no more than ┬Ż215 but for the same process post April 2019, this fee rises up to ┬Ż6,000!! Now thats quite a jump. POTENTIAL FOR MISHAPS In a recent case, there was considerable confusion for the heirs of a man who died with two Wills ŌĆō one made in England and the other in a foreign country where he owned property. The difficulty arose because his foreign Will ŌĆō which was only intended to apply to the assets he owned in the foreign country ŌĆō specified that it revoked all prior Wills. Although the revoke all prior WillsŌĆÖ clause is standard-form language in a Will, in that case it was not w...hat the testator intended to do. He wanted to have two Wills that worked in parallel ŌĆō one for the bulk of his estate in the UK and one for his foreign assets. Fortunately, it seems that the court accepted that the man had not intended to revoke his English Will, but the case (and the fact that it went to court) illustrates the potential for mishaps.
