Common Mistakes Number 10 - Sum up.
Remember if it's not in black & white it didn’t happen. Get everything in writing, especially about payments, repairs or things you have agreed with the landlord & then keep everything. Just because you have moved out does not mean you could not still be taken to court.

Common Mistakes Number 9 - Not getting proof of rent payments in writing.
It's not about what happened, its about what you can prove. Get everything in writing, especially receipts for rent paid in cash. They don’t need a lot of detail on, just the amount, the date, the address & a signature.

Common Mistakes Number 8 - Only reporting issues on the phone.
When you have a problem in the property, report it, then report it again & again. Do it in different ways. A phone call is not reporting the problem, it is letting them know, you can never prove this happened or what was agreed. Of course you don’t want to harass them. Try reporting the problem by phone call, let them know you will also drop them an email detailing the issue & what was agreed in the call. After another two weeks do this again, a more formal email with the issue, make reference to the previous email. After 1 month we suggest writing a letter as well as sending an email, some Landlords will claim they never got the email.

Common Mistakes Number 7 - They told me I can decorate.
You move in the house is horrible, so you ring the Landlord. Can I give it all a brush of paint?" Maybe even put some new carpets in? “Yeah of course, sounds great!” So, you go ahead, decorate the whole place, it’s beautiful, much better than when you moved in.
Two years later you move out & there it is £600 from your deposit to repaint the house!! You will lose this. If you want to decorate or make any changes to the property, again you need to get this in writing from the Landlord, stating exactly what you plan on doing to the property & that this will not need to be changed back when you move out, get this signed & keep it.

Common Mistakes Number 6 - The Landlord told me I could stay for 5 years.
It doesn’t matter what they have told you, the fact is with renting you can be evicted at almost any time, for no reason. Provided they follow the correct process & provide you with correct notices, you will have to move out. So be aware, whatever they say to you, it is not legally binding.

Common Mistakes Number 5 - Stop paying your rent.
The house is covered in mould, the boiler stops working; these things are horrible & hard to deal with, but you cannot just stop paying your rent under any circumstance. If you do you weaken your position massively, you might well be able to claim all this back later but you cannot stop paying rent. If you are having problems with disrepair in the property & are getting nowhere with the landlord, contact your local Environmental health department they have lots of powers to force the landlord to make repairs.

Common Mistakes Number 4 - Throwing away your documents after you leave.
DO NOT DO THIS. Keep everything. In fact, take photos, save them on a laptop or on your phone in a file with the property name & keep the hard copies as well. The law lets housing cases be brought for up to six years for things like rent arrears & damage, if you bin everything & the landlord brings a claim later down the line you could be in a total mess. Remember, even if the landlord is lying you have to be able to prove this, keep everything!

Common Mistakes Number 3 - Moving out early without correct permission.
This is a horrible one. You think its all agreed nicely; the landlord says sure, you can move out, then later down the line you get a big bill for months of rent. You are liable for the full rent for the full period of the contract. If you are moving out early, get something from the landlord that states you are allowed to move out on X date & you will not be liable for any more rent at the property.

When I found the post on a facebook site, I thought I would give it a go as my deposit had been kept by my shifty landlady. Our exlandlord tried to counterclaim for thousands of pounds of damage we didn't do, after they had already returned our deposit. We dealt with the old company name of tenant law uk. Very helpful and answering messages quickly. Our case went through to a lawyer who again was very helpful. However there were come discrepancies when it came to our actual case and the background checks had not been done correctly so although it appeared as though our landlord had not secured our deposit legally, they in fact had, as it was over 12 months since we left the tenancy. This resulted in the landlords lawyers saying we owed them money which our lawyers agreed they would cover themselves and we would not be liable for theirs or the landlords court fees. It had taken a year from the initial checks, to the information being realised and our case being cancelled. Hopefully this company has started checking properly but it just meant we had a year of extra stresses trying to deal with this when if it had been checked correctly to start with we wouldn’t have had the issues.
