BREAKING NEWS in ETS / TOEIC cases:
Home Office notifies this morning that they will withdraw their appeal to the Supreme Court against the Court of Appeal’s judgement in Ahsan & Others. By this mornings decision, the Court of Appeal’s judgment becomes final and binding upon all parties and lower Courts.
This is an enormous victory and success for everyone who had received a s.10 decision or a decision with only an out-of-country right of appeal, on the basis of an accusatio...n of using proxy in a TOEIC test.
Kudos to all the counsels and fellow colleagues who has helped us achieve this justice (after a 4 year long battle) for the clients who will most likely now have to go through an in-country appeal process.

Statement of Changes to the Immigration Rules HC667 was laid yesterday, 3 November 2016. The document weighs in at 90 pages, but many of the changes are to language rather than effect. The more significant changes are to Tier 2 skilled workers, for whom the minimum salary level is increased, to Tier 4, the introduction of a new English language requirement for family immigration and the abolition of the 28 day grace period for making out of time immigration applications.

UPDATE ON ETS / TOEIC case:
Great Outcome in the Court of Appeal in SM & Qadir case in which we won the case in the Upper Tribunal for our client SM.
Today the Home Office's appeal has been dismissed by the Court of Appeal. The Court found that Upper Tribunal made no error of law in allowing SM's appeal and it's decision was in accordance with established law and legal principles.... Those applicants whose Judicial Review / appeal in the Court of Appeal have already been dismissed / refused, should immediately consider making further submissions / representation to the Home Office inviting them to reconsider the case as a whole in the light of the new Court of Appeal judgment.
Those applicants whose appeal is ongoing in the Court of Appeal / First-tier or Upper Tribunal should best prepare their case, as each case will be considered on its own merit and in the light of the evidence presented in the case as a whole.
