“After last week’s decision by the Supreme Court holding that Section 3 of the Defense of Marriage Act (DOMA) is unconstitutional, President Obama directed federal departments to ensure the decision and its implication for federal benefits for same-sex legally married couples are implemented swiftly and smoothly. To that end, effective immediately, I have dire...cted U.S. Citizenship and Immigration Services (USCIS) to review immigration visa petitions filed on behalf of a same-sex spouse in the same manner as those filed on behalf of an opposite-sex spouse.”

At the EB-5 Stakeholder Meeting held yesterday, 16 October, nothing conclusive was accomplished. Some policy was clarified, but 2-3 attorneys agreed that they can't depend on anything said in a Stakeholder Meeting. It isn't necessarily applicable in a real EB-5 application. 1) There has been a restructuring of the EB-5 department within the USCIS, which may or may not mean faster adjudication. 2) A 'Conversation with Director Mayorkas and Rob Silvers' will take place soon, maybe next week, to clarify issues. 3) The USCIS is aware of the need to resolve the tenant-occupancy issue in the near future.

If you're on our mailing list you already know that the House of Representatives voted last Thursday 412-3 to approve the 3-year EB-5 renewal. It will probably be signed into law by President Obama this week. Interestingly, they have now removed the 'Pilot' from the wording of the bill, so it is now simply the EB-5 Regional Center Program. The Senate has Voted to extend the EB-5 Pilot Program for 3 Years. It's encouraging that the US Congress is already taking steps to avoid sundown of the EB-5 Program. If the House votes shortly upon its return from Recess, as we expect, the EB5 Program will be uninterrupted for another Three Years. http://www.eb5-visa.net/news.html#Senate_ vote
