Last week updates at Khan Associates: Two individual clients got their indefinite leave to remain under the new scheme Sopra Steria-Home office with in 24 hours under 5 year qualifying period-tier 2 of the the points based system of the UK Immigration rules, another was granted ILR under 5 year spouse route. One client got Residence card as the family member of an EU national. Another client was granted ILR in October this year under 5 year spouse route and now his application for naturalisation as a British citizen. Good News for Migrant Parents in the United Kingdom
FINALLY, the supreme court of United Kingdom has cleared the confusion on the 7 years rule; para 276ADE(1)(iv).
... When assessing the ‘best interests’ of children affected by immigration decisions, the focus must be on the child alone;
When considering whether it is reasonable to require a child to leave the UK (under the 7-year rule), that question should be answered in the family context. If the child’s parent/s do not have lawful status in the UK and must leave, that fact will be relevant to the question of whether it is reasonable to expect the child to follow them; and
When deciding whether the impact of deportation is ‘unduly harsh’ on a child (under section 117C(5)), the focus must be on the child. The gravity of a parent’s criminal offending is not relevant at that stage.
SC re-affirms the importance of the principle that children should not be held responsible for the conduct of their parents.
This decision supports claims of those parents who have over-stayed or otherwise ceased to have right to remain in the UK however they are still required to prove that it will be unreasonable to expect their child to leave the UK in comparison with where he can return with parents.

PSC-HOME OFFICE GLASGOW TODAY: One female client already on student visa/ Tier4 married in UK GLASGOW, granted spouse visa on the same day service in 2 hours duration only and her immigration status switched from tier 4/student to the spouse of a British citizen easily. Two clients got the good news today, one lady client was granted indefinite leave to remain under old rules where £18600 threshold was not required and another got extension/ further leave to Remain as a spouse of British citizen under the financial threshold while he was on 10 year partner route previously and was eligible for ILR after 10 years as a partner. Now he is eligible for ILR after 5 years. Once he was called by staff he became so happy because he was aware that khan Associates saved his 5 years long wait for ILR. Love my job and pleased for clients on their good result. We give our clients positive results not excuses!!

A Nigerian client granted residence card today as the family member of an EEA national wife. The EEA national was on maternity allowance at the time of filing application and once the client was informed he became so excited, I love my work we work with full dedication!
