UK to loosen visa rules for graduates and researchers

Yesterday, the UK Government published a paper outlining their offer for EU citizens in the UK.
The following is quoted from GOV.UK:
“The UK government’s offer for EU citizens is:... -People who have been continuously living here for 5 years will be able to apply to stay indefinitely by getting ‘settled status’. That means these citizens will be free to live here, have access to public funds and services and apply for British citizenship. -People who arrived before the cut-off date, but won’t have been here for 5 years when we leave the EU, will be able to apply to stay until they have reached the 5 year threshold. They can then also apply for settled status. -People who arrive after the cut-off date will be able to apply for permission to remain after the UK leaves the EU, under the future immigration arrangements for EU citizens. -Family dependants who are living with or join EU citizens before the UK’s exit will also be able to apply for settled status after 5 years in the UK. In these cases the cut-off date won’t apply. The cut-off date will be agreed during the negotiations but we are clear that it shouldn’t be earlier than 29 March 2017 (the date Article 50 was triggered) or later than the date the UK leaves the EU.”
Under the proposals all EU citizens and their families in the UK will need to apply to the Home Office for permission to stay. The type of application you will need to make will depend on your circumstances.
Although the UK Government have said that there is no need to do anything now, it is probably wise to start examining your own circumstances and those of your family members to make sure that you are fully prepared for any steps you have to take to secure you legal status in the UK.

Stricter English language requirement for non-EEA partners and parents
As announced by the Home Office in January this year, a new English language requirement at level A2 of the Common European Framework of Reference for Languages is being introduced for non-EEA partners and parents.
This affects those applying to extend their stay after 2.5 years in the UK on a 5-year route to settlement under Appendix FM (Family Member) of the Immigration Rules. The new requirement will ap...ply to partners and parents whose current leave under the family Immigration Rules is due to expire on or after 1 May 2017.

Overseas criminal record certificates
From April 2017, the Government plans to extend the requirement to provide a criminal record certificate to Tier 2 visa applicants coming to work in education, health and social care sectors and to their adult dependants.
Tier 2 visa applicants who are coming to work in an occupation defined by the relevant Standard Occupational Classification (SOC) code, and their adult dependants, will need to provide a criminal record certificate from ...any country they have lived for 12 months or more in the past 10 years.
It is the sponsor’s responsibility to inform their prospective employee of the new requirement. Failure to do so may result in refusal of the visa.
Sponsors are advised to inform prospective employees assigned a certificate of sponsorship from January 2017.

New Immigration (European Economic Area) Regulations 2016 were laid on 3 November 2016. Please note the following changes:
From 25 November 2016: -Applications based on the Surinder Singh route will be refused “where the purpose of the residence in the EEA State was as a means for circumventing any immigration laws applying to non-EEA nationals to which [the family member] would otherwise be subject”

From 1 February 2017: -Power to require EEA applications to be made in a prescribed manner -Abolition of right of appeal for extended family members -Power to remove a person while an EEA appeal is pending where the person is judged to have no right of residence -A child does not need to have been in education at the time the EEA national parent left the UK. -New “verification” process for the Home Office to check whether an EEA national or family member really qualifies for residence -New “misuse of rights” provision

UK government has announced today, changes to the Immigration Rules which will affect applications made on or after 24 November unless stated otherwise.
The main changes are outlined below:
Tier 2... Implement the first of 2 phases of changes to Tier 2, announced by the government in March following a review by the Independent Migration Advisory Committee.
Increasing the Tier 2 (General) salary threshold for experienced workers to £25,000, with some exemptions Increasing the Tier 2 (Intra-Company Transfer) salary threshold for short term staff to £30,000 Reducing the Tier 2 (Intra-Company Transfer) graduate trainee salary threshold to £23,000 and increasing the number of places to 20 per company per year Closing the Tier 2 (Intra Company Transfer) skills transfer sub-category These changes will come into effect for all certificates of sponsorship assigned by Tier 2 sponsors on or after 24 November 2016. The date from which intra company transfers will be liable for the health surcharge will be announced in due course.
Tier 4 A number of changes are being made, including amendments to the academic progression rule, maintenance requirements for the Doctorate Extension Scheme and evidence of overseas qualifications, UK qualifications used as evidence, and a series of minor and technical adjustments.
