This certainly backs up our experiences with HMRC recently. Very happy to take an aggressive stance in the hope they can bully more money out of the taxpayer using inexplicable reasons, poorly written letters/judgements and doing the equivalent of sticking their fingers in their ears and shouting 'la la la I can't hear you' at anything you put to them which disproves what they are saying!

We have just assisted on a case where HMRC admitted being 'misi...nformed' by a colleague a very basic piece of legislation (s.3(1) IHTA84) which would have yielded £200k+ in IHT for transfers thought to be gifts, but clearly weren't. They accepted the legislation did not say what they were making it out too!. Not just the tax at stake, but the anguish to the poor relatives who had to deal with this attitude who had done nothing wrong.
