Presently there is no formal abandonment procedure for landlords in the Private Rented Sector to be able to recover abandoned properties unlike Housing Associations and Local Authority landlords. This is set to change as part of the Private Rented Tenancies (Scotland) Act 2016 (2016 Act) which will provide a basis upon which the Landlord can terminate the tenancy when they believe the property to be abandoned. This will remove the current risk that a tenant could return and ...claim s/he had been unlawfully evicted. The 2016 Act provides that where the tenant no longer occupies the property as their only or principal home the landlord can serve a notice to leave giving only 28 days’ notice. Once the notice to leave expires the landlord can apply to the First-tier Tribunal Housing and Property Chamber for an eviction order. The Tribunal must grant an eviction order if satisfied that the property is not being occupied as the only or principal home of the tenant and that lack of occupation is not a result of the Landlord’s breach of the Repairing Standard. Legionnaires’ Disease Is a pneumonia-like illness caused by legionella bacteria and is potentially fatal. Everyone is susceptible to infection. Domestic hot and cold water systems can provide an environment where Legionella bacteria can grow. Legionnaires’ Disease can be caused by the inhalation of small droplets of contaminated water containing the... Legionella bacteria.
Things you can do Do not interfere with the settings on your boiler or hot water system. The hot water should be set so that the water is heated up to 60°C. If you have a shower and its used only occasionally, then flush it through by running it for at least 2 minutes once a week. Its recommended as far as possible to keep out of the way whilst this is being done. Clean the shower head periodically, descale and disinfect it. This should be done at least every six months. When you come back from holiday etc, both hot and cold water systems should be flushed through by running all outlets for at least two minutes. And report any problems.
While it is the landlord’s responsibility to take precautions to prevent Legionella being present in the hot or cold water system, Tenants also have an important part to play in taking these simple and practical precautions.
