Dear all, we hope your enjoying the bank holiday weekend. We have an update regarding a case we talked about yesterday;
Our client's daughter who is only 9 years of age suffers from a condition known as Ulcerative Colitis, an inflammatory bowel disease that affects the intestines. This requires her to constantly use the toilet. It has resulted in issues with attendance at school and regular hospital visits.
The DWP refused to provide DLA (Disability Living Allowance). Yesterd...ay after hours of research we concluded there was not much more that could be done as the condition was not serious enough by the DWP standards.
Today we again researched the case law and have struck luck with the case of CDLA/3162/2011(2012) UKUT 312 (AC). The decision states that there will be a difficulty in walking short distances with this condition and that the day and night care component could be satisfied!. We are relieved and now hope for the best!!

We have recently had a client who wishes to appeal against the decision of the DWP in refusing to award him Disability Living Allowance for his daughter who has a severe condition known as Ulcerative Colitis. This is a condition which can result in abdominal pain, diarrhoea rectal bleeding and fatigue. It requires you to be very close to a toilet. Unfortunately where a condition is controllable the DWP will do very little to award a day or night care allowance. This is the sad truth that although you may spend your days in and out of the hospital for your child at your own cost, unfortunately there will be no recourse to public funding for this. This is proven by the DWP Impairment indicators which will give you more of an understanding of whether your appeal is worth challenging. In our client's case, there will be no award given.

We had an on going boundary dispute between two neighbours which lasted more than 2 years. Our clients were left to run their own case after their solicitor (provided by their insurers) took more than £16,000 in legal fees and abandoned them, charging every time they called even if they did not get through . We were presented with 3 lots of bundles which the Claimant Neighbours had made themselves. They came to us having little faith in the legal system. The case involved a... planned extension by the Claimants to the rear of the property, a new kitchen and loft conversion. Both neighbours employed architects and other professionals and had written agreements confirming they agreed to the Claimants plans. Unfortunately as the work began the extension and proposed works were halted by disputes regarding the boundary line. The Defendants took legal action demanding money for damage caused to their roof and windows prematurely knowing that this would scare the Claimants to abandon their idea of extending their home. Constant letters from Barristers raised the pressure further on the Claimants. After we received the correspondance, we put an end to the Defendant's unfounded claims which were supported by inaccurate evidence. We challenged the Defendants further by ensuring that they paid not only damages for inconvenience and stress but also the health condition of our clients which worsened over time due to the legal proceedings. Overall we gained a large figure of compensation, continuation of the proposed works and restitution of the Claimant's garden which the Defendant's decided to decrease by erecting their fence over the Claimant's garden making this look smaller in size. We received constant correspondance from the Defendant's new Barristers saying we did not have any cause of action against them. We however persisted and never gave up. Our clients reaching their mid 70's simply wanting peace of mind and a better looking home. They visited us on weekends, yet we kept our costs to a minimum. This is the heart of true service.
