We are aware that our clients have been contacted directly by banks – we know because our clients have told us. The banks claim that you don’t need to go to a CMC or a solicitor to make a claim. Why do they say this? What difference does it make to them?
We believe the answer is that the banks tend to under-compensate unrepresented claimants. The banks will deny this but time and time again we have demonstrated that an unrepresented claimant is likely to achieve a poorer... outcome. Claimants will have to factor in the costs of being represented by Lincoln Green, this is true, but sometimes the difference is many thousands of pounds. There is also the real risk of the claim simply being rejected….
If you have not made a claim yet then a bank may contact you in order to pre-empt your claim. Where a bank has started to settle a type of claim history suggests that they will accept the situation and try to proactively mop up other claims – think PPI as an example.
Our advice is, therefore:
+ If you think you have a claim contact us first
+ If you have made a claim yourself and have been rejected contact us now
+ If you have been unexpectedly contacted by the bank and you haven’t made a claim contact us now
We know our existing clients will tell us if they have had direct contact because they know we have their interests at heart.

So far there is little evidence that consumers have actually received any help to recover monies that they have previously paid for timeshares which was the original point of the first phone call. The “scam” that we have described is purely to sell another product at highly inflated prices.

This “scam” was reported on the BBC programme Rip Off Britain on 31 January 2019, where they filmed outside the offices of one of the companies that was involved.
