If you have already made the decision to get your Will written and you have opted to use either the bank or even a charity then please be careful of hidden fees that could occur upon death. I recently saved a couple upwards of £20,000 in probate fees. Their previous Wills were written by the bank. The bank were appointed as executors and would have charged their estate 4% on death. ... If you’re married… People assume their estate will automatically pass to their spouse when they die. However, under intestacy rules, the spouse isn’t entitled to everything if the estate is worth more than £250,000 – only to personal items worth up to £250,000, and half of the remainder of the estate. The other half must be split between the children.
If you’re not married… Your partner will have no rights to your estate.
If you have children… They will receive their share of your estate at the age of 18. If they are under 18 and you haven’t appointed a guardian for them, they could end up in foster care while the court appoints one of its choice.
If you have multiple properties… Everything has to be added into the pot. Even if your spouse is living in a property you own, they won’t automatically get it. If the house is worth more than £250,000 or there are debts, they either need to buy the house or it gets sold. Everything is worked out by value, so if their share of the estate doesn’t cover the value of the property, they will have to pay the extra back to the estate – or move out. For example, if the property is worth £300k and the spouse is entitled to £250k, they need to pay back £50k. If you own the property together, your spouse will get it automatically only if you own it as joint tenants.
If you have property abroad… It will be dealt with according to the laws of that country.
If you have a business… Your company’s interests go into the pot with everything else. The shares could then pass to a family member who has no idea about the business.
If you have step-children… Without a will, they receive nothing.
