In what circumstances can an employer revoke a conditional job offer?
We have recently advised a number of clients who have encountered issues with public sector employers who have revoked conditional job offers on tenuous or flimsy grounds. Employers are under a legal duty to establish whether prospective or current employee suffer from a disability or disabilities, as well as making reasonable adjustments to allow a disabled person to attend interview or und...ertake the duties of the role in question. Large public sector organisations often have dedicated occupational health functions to assess the provision of reasonable adjustments. Those employers who take decisions without first considering the consequences of relevant disability discrimination legislation may be acting unlawfully. In an employment dispute it is important to act quickly.
