When someone dies, it can be a very difficult time, and, in many cases, there will be a requirement to obtain a Grant of Probate. The need to obtain a Grant of Probate, or Letters of Administration, generally means that you are applying to get permission from the Court to deal with the estate and where there is a Will, to carry out their wishes. It means that you as the executor have the legal responsibility to administer the estate assets and the Grant of Probate or Letters ...of Administration proves this.

Many couples make simple mirror Wills leaving everything to each other for life and then to their children thereafter. A lot of couples don’t consider what would happen if the survivor of them required care in the future and as a result the local authority would have the power to use their finances to cover the cost of care. Currently, if a person’s total assets, including property, is more than £23,250 the local authority will expect them to pay care fees in full. It is only... once their assets have fallen below £14,250 will the local authority pay the care fees.
Therefore, if the survivor requires care, the assets they have gained over many years may be depleted by care fees leaving little or no inheritance for their children. However, there is a form of protection that couples can put in their Wills to help avoid this and that is leaving a life interest to the surviving spouse.
